Liability and Forfeiture
According to Chapter 134 of Hawaii Revised Statutes:
- Firearms owners are absolutely liable for personal injury or property damage caused by misuse unless reported to police as stolen. It is called an “Affirmative Defense” for the firearms owner if the firearm was reported stolen prior to its use.
- To prevent access by minors, firearms must be kept in a locked box or container or in a location that a reasonable person would believe to be secure.
- Carrying loaded firearms in a vehicle on a public highway shall result in forfeiture of both the firearms and the vehicle.
- Any case of domestic violence or temporary restraining order shall result in seizure of all firearms and ammunition.
